Who is Eligible for Asylum in The U.S.?

The applicant must be in a protected class based on: race, religion, nationality, social group, or political opinion.
The applicant can ask for asylum at a port-of-entry at our borders, an airport or seaport, and must file the application within one year of the arrival in the United States with some exceptions noted.

Types of Asylum Applications

Affirmative

An immigrant may apply for asylum with USCIS (affirmative) if the applicant has not already been placed in removal proceedings. An asylum officer will then review the application and evidence and schedule the applicant for an interview. During the interview, the officer will decide whether to grant the asylum or refer the case to an Immigration Judge for a final decision.

Defensive

If the immigrant has already been placed in removal proceedings, the applicant must present their Asylum before an Immigration Judge.
